i need legal advice???please help me?

this is whats going on i had got hurt on my job and have been out of work for a year workmans comp has sent me sporadic checks here and there nothing close to what i was making i just had arthoscopic surgery to remove scar tissue from my knee during this year i have lost almost evrything i owned from my car being repossessed i currently being evicted ive had to sell my big screen tv and ps3 and just about anything else i owned just to survive now not to sound like a money hungry person but can i expect a settlement and how much can i expect i have a lawyer but he always seems to busy to actually sit and talk with me about this not to mention how uncomfortable it is to ask theses questions face to face without looking like im trying to scam a system please any advice will be much appreciated this situation has been mentally and physically draining on me and my family ive worked hard for everything i owned and have lost it all i did not live past my means i worked 6o hours a week for 12 years at the same company i said i worked very hard for everything i got and now i have nothing i worked for an ambulette company my job was to assist carry down patients who sometimes lived on third floor or higher and could not walk and get them to there appointments the call i was injured on i and several other people complained to no avail how dangerous it was the man was 400lbs with one leg coming from the second floor up and down every otherday i had to carry him in his wheelchair cause for my company it was not cost effective to have a crew waiting an hour for a stair chair to arrive with an other crew

  1. Workman's comp rarely pays what you were getting, neither does unemployment. GO, talk to your attorney. He is on your side, and it's to his benefit that you win your case. ASK him all these questions. He knows the system, or should, and should be willing to answer your questions. REquest an appointment, write your questions on an index card, and go SEE him and ASK everything. He's not a friend, he's your attorney and this is a confidential consultation.
  2. IF your checks have only been sporadic, there is a problem there. These payments are NOT going to be anywhere near your full salary, but should be regular. Sounds like you were living beyond your means, and now it has come home to roost. Have you applied for government assistance with ALL the appropriate agencies? Possibly you need a different lawyer, but you have to remember that you are not his only client.
  3. Maybe you need a different attorney, one who will take the time to talk to and listen to you. You shouldn't feel uncomfortable asking your lawyer questions, that's one of the things he or she is there for. Any possible settlement would depend on how the accident happened, and how much the employer was responsible. Good luck.
  4. You need to either get your attorney to cooperate or find one that will. If you were indeed injured on the job your attorney needs to step it up. You have a suit. Forget about how it feels to you. You are not trying to beat the system. It is in place for people like you that genuinely need it. the ones that abuse it are the ones injured elsewhere and claim it was at work. As far as your payments go, workers comp will never be the full amount that you made unless you have a suplimental insurance. They should be coming regularly, if not call them and ask why they are not.
